COMMENTS OF THE PUB LIC UP I LITIES BOARD OF THE CITY OF BROWNSVI LLE , TEXAS ON CONSOLIDATION OF PROC EEDINGS During the March 7, 1980, prehearing conference pro-ceeding, the Licensing Board indicated it would consider sua sponte the issue of consolidation for trial of the South Texas and Comanche Peak proceedings, and requested comments from the partie s within ten days . The Public Utilities Board of the City of Brownsv ille , Te xas , ("Brownsville") hereby files its comments.

Brownsville takes no position on whether the proceedings should be consolidated.

Brownsville is concerned, however, to preserve its right of cross-examination in the event of a consolidated proceeding. It would appear from the discussion on March 7, 1980, that this Board may be disposed to restric t cross-exa.nination on the basis of which proceeding a party formally par tic ipa te s in. Brownsville believes that it should be B Cr4 0@

- allowed, if the proceedings are consolidated, to cross-exa:aine any witness as to any matter relevant to the South Texas proceed ing , regardless of which party is sponsoring the witness. At the December 5, 1978, prehearing conference this matter was discussed and, Brownsv ille thought, resolved in favor of a full right of cross-examination. (Tr. 63).

In the al te rna tive , if the Board should rule that cross-examination may be restricted in a consolidated proceeding ,

Brownsville respectfully requests that it be admitted as a party to the Comanche Pp'i proceeding . Brownsville's in te re s t is se t forth in s Supplemental Petition for Leave to Intervene, dated June 28, 1978, hereby incorporated by reference. This interest would be af fected by consideration of common issues in a consolidated proceeding , including but not limited to the nature of competition in the electric util-ities industry in Texas, and the past and present actions and policies of the utilities in Texas with respect to transmission planning and policy, bulk power supply, and mem-bership in the Texas Interconnected System.
