Three Mile Island Alert, Inc. (TMIA) by its attorneys, Widoff Reager Selkowitz & Adler, P.C., move the Nuclear Regulatory Commission provide emergency funding for the purpose of continuing the taking of depositions of Licensee employees, and set forth the following reasons in support thereof:

(1) TMIA, Inc. has virtually expended all the money available to it for the taking of depositions of Licensee's employees; (2) TMIA, Inc. presently has incurred financial liability in excess of $30,000 as the cost of its participating in the TMI-l Restart Hearing. Over $20,000 remains to be paid, and additional discovery, including depositions, will increase that figure substantially.

(3) TMIA, Inc., is the only intervenor actively pursuing those areas of management and financial competency set forth in the Commission's March 7, 1980 Order.

(4) Unless TMIA, Inc. can complete all the depositions presentl'y scheduled, this Board will be deprived of information essential to a full hearing into these areas  ;

mandated by the Commission's March 7, 1.980, Order.

(5) Intervenor funding by the Commission has been expressly approved by the Comptroller General in an opinion dated January 1980, a copy of which is attached hereto.

Because of the importance of this Motion, TMIA, Inc. requests immediate certification to the Commission. Copies of this Motion are being sent directly to all Commissioners, and the Commission's General Counsel in order to expedite a review.
