s Dated 4/22/76 and 11/17/76 Gentlemen:
In reference to your letter to us on this subject dated April 22, 1976 and our reply dated May 19,1976,10 CFR 50.55a(g)(4)(v) states:
"For an operating boiling or pressurized water-cooled nuclear power facility whose operating license was issued prior to rtarch 1, 1976, the provisions of para-graph (g)(4) of this section shall become ef fective after September 1, 1976, at the start of the next regular 40-month period of a series of such periods beginning at the r, tart of facility commercial operation."
Based on the Rancho Seco commercial operation date of April 18, 1975, our first 40-month peried would normally end at the third refueling which would have occurred in the fourth quarter of 1978.
This was the basis for the corr.mitment in our letter of May 19, 1976, to submit our updated program in June, 1978, based on a refueling date of December, 1978.
At the time of the May 19, 1976, letter, Rancho Seco had gone j
through an extended outage of approximately eight months due to turbine repairs and was in an outage for removal of the Surveillance Specimen Holder Tubes from the reactor core barrel.
This outage ultimately lasted more than six momths to rewind the main generator; however, this fact was not known at the time our letter was written.
Because of these two extended octages, our third refueling will not occur until the fourth quarter of 1979, rather than fourth quarter of 1978.

Reid January 24, 1978 Paragraph IWA-2400(c) of Section XI of the ASME Boiler and Pressure Vessel Code states, "For power units that are out of service continuously for six months or more, the inspection interval during which the outage occurred may be extended for a period equivalent to the outage." We feel it is the intent of the code to provide for inspection based on operating time rather than e spsed calendar time i
and therefore, propose to revise the schedule we submitted in our May,1976, letter.
We propose the following schedule for submittal of our revised Inservice Inspection Program:
Pumps and Valves:
Program to be submitted during the first quarter of 1978.
Piping and Vessels:
Program to be submitted during the second quarter of 1979 based on third refueling in fourth quarter of 1979.
If we do not receive a reply from you by February 28, 1978 to the contrary, the revised submittal schedule will be pursued.
