Dear Mr. Chilk:

Mr. John A. Eyed, President, Sassafras Audubon Society, is in Florida for an extended stay and during this period our Co=mittee would like to receive a copy of any communi-cation which you might send to him.

Sassafras Audubon has learned that Public Service Indiana, Inc. (PSI) has submitted its revised quality assurance program to the Director, Office of Inspection and En-forcement, accompanied by a request for the lifting of the Order confirming suspen-sion of construction, yet we havehad no answer to our appeal for a Hearing on the Order of suspension from the Commission.

We await a reply.

With regard to your letter to us of February 7,1980, we are cognizant of 10 CFR 2.206 (c) (1) and (c) (2). The Director's decision of November 27, 1979 was essen-tially a pro forma reply to the substantive issues raised in our request for a Hearing at a meaningful point in the licensing process, and as such, we felt it an abuse of discretiot ry power.

Our appeal to the Nucleat-Regulatory Commission of December 10, lgr/9, was a protest against a regulation and a system which can so easily dismiss a final administrative appeal without reason or explanation. It may seem futile, but the orotest was for the record.
