Dear Mr. Doherty:
This % in reply to your letter dated January 31, 1980, and also in fur a reply to your four earlier letters submitted under the case numbers stated above.
In all of your letters you requested, pursuant to the Freedom of Information Act, copies of documents which you listed and specifically identified by Accession Number, Report Number, Author, number of pages, and brief description.
In partial response to your four requests, the documents listed in Appendix A are enclosed (total 369 pages), except for documents 5 and 26 which are withheld.
Our search is continuing for the other documents j
which we were unable to locate readily.
We will communicate further with you when we can provide you with copies of the balance of the documents on your lists.

While it is agency policy, pursuant to 10 CFR 9.14 of the Commission's regulations, not to waive reproduction fees for documents placed in the Public Document Room in the absence of a compelling reason to do so, an exception to that policy will be made in light of your representation to pay one fourth of the cost of reproducing the documents, and in consideration of the fact that you~ have also represented to the NRC that you are an Intervenor in the construction permit hearing proceeding concerning the Allens Creek Nuclear Generating Station.
Accordingly, for the 369 pages of documents enclosed, please send a check in the amount of 59.23 payable to the "U.S. Nuclear Regulatory Conmission" along with a copy of this letter to the Director, Division of Rules and Records, MNBB-4210, U.S. Nuclear Regulatory Commission, Washington,.DC 20555.
With respect to documents 5 and 26 of Appendix A, these documents contain information which is confidential business (proprietary) information and is beir.g withheld from public discicsure pursuant to exemption (4) of i
the Freedom of Information Act (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) cf the Cc=ission's regulations.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been deterndned that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.
