Dear Mr. Bates:

This is to acknowledge receipt of your letter in support of the December 11, 1979 petition on behalf of the Friends of the Earth request that the Nuclear Regulatory Comission take four steps to restrict the operation of the facility located at Etcheverry Hall on the University of California, Berkeley campus.

The Friends of the Earth petition is being treated under 10 CFR 2.205 of the Comission's regulations, and accordingly, appropriate action will be taken on their petition within a reasonable time.

RE0L'EST FOR ACTION UNDER 10 CFR 2.206 Notice is hereby given that by petition dated December ll,1979, the Friends of the Earth requested that an order be issued to the Regents of the University of California at Berkeley to suspend all activities of the TRIGA reactor at Etcheverry Hall, to remove all radioactive materials from the site, to revoke the operating license and to hold public hearings before any reactor operation is resumed.

The bases of the request are alleged deficiencies in the seisr.:ic design of the facility, and allegat.ons that the potential threat to the public health and safety is greater than pre-viously estimated and that current evacuation plans are inadequate. This petition is being treated as a request for action under 10 CFR 2.206 of the Comission's regulatior.s, and accordingly, action will be taken on the petition within a reascnable time.

Dear Dr. Denton:

}

I hereby endorse the Request for Action submitted by Friends of j

the Earth to the Nuclear Regulatory Commission which requests permanent revocation of the Regents of the University of California's Operating License under Docket No.30-224.

i i

Considering the Etcheverry Hall Reactor's outdated seismic design, its site in a densely populated urban area and the lack of adequate evacua-tion plans in case of a radiation accident, I submit that the Etcheverry 4

!!all reactor poses an unacceptable threat to public healty and safety.

Accordingly, 1 give full support to the Request for Action to the l

N.R.C. filed by Friends cf the Earth.

I concur in the request that all re-actor activities under Decket No. 50-224 be halted, all radioactive materials and wastes be removed f res the Etcheverry llall site, and that the reactor operating license be re=cved by the Nuclear Regulatory Co==ission.

I ask that the Euclear Regulatory acknowledge its responsibility.to the health and safety of the citizens of Berkeley by acting upon this Request I

for Action.
