TMI-1 OL HEARING July 17,1979 In connection with our discussion this morning regarding TMI-1, I have been infor.ned by John Frye of the Licensing Panel that the OL hearing in that proceeding was dismissed on stipulation of the pcrties.
As you will recall, CLI-73-5 (6 AEC 43) granted intervention in the OL proceeding to Citizens for a Safe Environment and Environmental Coalition on Nuclear Power. According to Bob Bernero (you infonned me) the parties met for three days with the Licensing Board appointed by the Commission in CLI-73-5 before agreeing to settle the case.
This is consistent with Frye's files. He finds a Joint Motion to Dismiss dated November 11, 1973, accompanied by a Stipulation.
This material is being sent to us by Frye.
However, the Licensing Board fanel does not have a copy of the Licensing Board Order dismissing the proceeding. The Board does have a Press Release dated November 23,1973 announcing that action.
If it is important for us to see the final Order, Frye believes it is available from Chase Steven's office. Please let me know if you think it is important and I will contact Stevens. $
A third confirmation of settlement was provided by J. McGurren, OELD. Although McGurren was not the attonrey of record in that proceeding, he is currently assigned tc the TMI-1 case.
It is his recollection that Joe Gallo, former OEI D Hearing Chief, agreed to a settlement in TMI-1 by which the Intervenors agreed to drop their contentions on the Applicant's promise to install a kidney filter.
I am not aware of what a kidney filter is or does, but McGurren believes that the Company did install it subsequently.
