Om-01, Policy - The first paragraph should be qualified some-what to reflect our responsibilities and authority under our i

regulations, The Atomic Energy Act, and Energy Reorganization Act. In particular, the term " responsible authorities" needs definition and clarification. NRC's authority to issue orders for the protection of the public should be discussed here and e

also in Section om-04, 031g. on pages 4 and 5.

Om-03, Definitions - The definition of " Incident" needs clarification, especially uhat is = cent by "off-nor=al"op~ ration e

of facility systems." Guidelines for determining what con-stitutes an " incident" need to be established. In addition, for this Manual Chapter, additional clarification is needed as to what " incidents" initiate the various NRC actions.

Om-04, Responsibilities and Authority - In Sect. ion 031a.

additional guidelines for informing "other approp';iate agencies" are needed. In Section 031g. the

. down authority is discussed. The questica of responsibility and authority to order actions (such as shutdowns) should be discussed and resolved in the context of this Manual Chapter.

Clearly in some situations the Director of IE should have the unilateral authority and responsibility to order such actions.

In other circumstances the decision may more properly be the responsibility of the Directors of NRR or NMSS.

Om-Part 1, HQ Plan for Response to Incidents - In Section C, the selection of the IRACI support staff from NRR should be j

made by the Director of NRR based on requests from the IRACT director.

j support staff to the HOEC should not only be made at the request of the Director, I & E, but also at the initiative of the Director, NRR.

Consideration should be given to expansion of Section L to include other agencies, such as DOD, with capability in emergency radiological assistance.

OXXX-Part III, Procedures for HQ Investigations Review of Incidents - The upper limit of seven membersof the IP.C should be removed since some cases may require more than seven members to cover the required disciplines and interests.
