Dear Dr. Brown:

I was quite pleased to learn of your willingness, schedules permitting, to serve as a consultant to me in my capacity as Director of the NRC/TMI Special Inquiry e

s Group. We will be establishing pancis of consultants to review and comment on the plans for the Special Inquiry's investigation and on its draft final report.

It is my hope that we will benefit from reviews and comments that encompass a wide range of backgrounds and perspectives.

I am enclosing a description of five separate panels.

It is my hope that your schedule will allow you to serve on panel II.

This panel will hold its first H

session in Bethesda, Maryland on August 13 and 14, 1979 to review and comment on

,j the draft report outline as well as on the current plans for the investigation and associated analyses.

Later in the fall, I intend to reconvene this panel for several days to review and comment on a draft of the final report.

a In addition to the two planned sessions, issues or questions may arise in the interim and I may ask specific panels o: individual consultants to address such C

matters.

The time required for all these efforts is not expected to exceed a total of ten days.

All the information used as a basis for developing the report will be publicly 3

available when the report is published.

However, until the report has been published I would request that material that is made available to the panel consultants be kept confidential.

It should also be noted that while I expect to benefit from the reviews and comments of each panel consultant, the content p

of the Inquiry's final report will remain my responsibility.

I do intend to include an appropriate disclaimer in the report stating that the concurrence of.

e You will be allowed travel and other expenses while away from your home or regular place of business, including per diem in lieu of subsistence while enroute to, and at the place of Inquiry Staff employment.

The amounts author-ized for travel and per diem will not exceed those authorized for Federal employees in accordance with the standardized government travel regulations.

Since you will be a consultant to me and not to the Nuclear Regulatory Commis-sion, you should bill my law firm c ucctly.

SIG SCOPE OF 1:3RK in Ehe coract of the work uncer this centract, the Centractor shall cesignate W. Mitchell Rogovin to serve as Direc:cr of the Special Incuiry to review and report to the Corer.ission on the accicent which took place at the Three Mile Island Nuclear Station tio. 2 (TMF-2) beginning on March 28, 1979.

The Con-tractor will have the authority to designate a staff of his own choosing, including both NRC personnel, and staff and consultants from outside the Com;nis-sion.

It is expected that in assembling a staff, the Contractor will draw substantially on senior Comission staff including Ccaission personnel and censultants currently engaged in conducting an interim inquiry ir,to the matter.

The Contractor shall contact the Contracting Officer's Authorized Representative (CCAR) to arrange for such technical assistance as can be provided by NRC personnel.

The Contractor, utilizing such resources, shall examine the following areas of inquiry:

l.

the sequence of events during the accident,.what was happening to the reactor and the plant, including, where feasible, an assessment of important alternative sequences; the response of the operating personnel; radioactive releases and exposures; events at the plant before the accident that might be related to the accident.

2.

the history of the NRC review of the utility's application for a license to operate Three Mile Island No. 2; NRC license conditions on TMI-2 opera-tions, including technical specifications; the operating and inspection history at TMI-2; the operating and inspection histories of other Babcock

& Wilcox plants, focused on any indications of the types of problems that arose in the TMI-2 accident; a sumary of NRC past considerations of such problems; the extent to which financial or tax considerations influenced conditions in the plant in any way that might have contributed to the acci-dent; any other precursor evants or analyses relevant to the accident.

3.

the susceptibility of Babcock & Wilcox plants to accidents; unique features of TMI-2 that may have increased or decreased the severity of the accident; other design effects related to t'he TMI-2 accident.

4.

TMI-2 cperations, including training and qualifications of personnel, oper-ating personnel, operating procedures and management overview; technical support to operating personnel and management.

5.

c=ergency response to the TMI-2 accidant by the utility, other utilities and utility groups, and industrial crganizations, including coordination l

with NRC and other Federal, State, and local officials, and assessment and k

dissemination of information.

6.

emergency planning by, and' emergency response plans approved by, the NRC; actual emergency response to the accident by NRC, including staff, ACRS L

and Comc.issioners, on site and at headquarters; t;RC coordination with

The Special Inquiry will also assess the possible implicaticns of the accident at TMI-2 (including design of the facility, cperations, regulatory actions, j

emergency preparedness) for other existing and future nuclear power plants and identify areas where further study is recctmended.
