JC?&L ?urchase Order C-0052 Gentlemten This is */our formal notification that the subject valves sold by you to JC?6L for use at TXI-2 have failed to =aet the performance requirements c,f the applicable specificacions.

This failure.first noted on April 23, 1978 was pronp:1y brought to your atten:1on, and in reco;;nition cf the f act ths: the valves were not parforn-ing properly, you (with our cooperazion) impicsented various mcdificatiens or adjustmants in an at:cmpt to rc ady the since :ha: ti;te. hone of these steps has succeeded and the valves continue to fcil below specified performance requircmonts.

Since more than two mon:hs have clapsed followin; the di: cover'/ of the p:obics and the trial of various uncuccessful solu: ions of the problem, it. is out opinion th:t these vcives cannot be corrected to meet our rer.uirc ents. As you know, these defective valves have delayed and are continuin; to doicy the com:tercial operation of TMI-2, causing the owncra excessive costs and their customers higher rates.

T.aving given you cvery opportunity to rec:ify the valves so that they could meet specification, in viou of your inability to do so, we now believe tr.at no other alteruspvo is available but' to reject the valves since they do not conform with' con: factual requircsents and to proceed with "rcetification" ss provided for in the contract. decision to replace the valves with valves from another sourec, and we deca this to be' the most prudent approach for both our companies.
