_ft Yw s Rev. Rui 76 428, issued in 1976 spells out the various criterin to be used in establishing the date that a nucicar genornting statien is "first pinced in service" for purposes of deducting deprecintion in deternining taxnble income under the Internal Revenue Code.

Without enumerating all of the criterin spelled out in nev. Rul. 76 478, it would appent that ml :to. 2 has passed most of the hurdice, encompnsced in x

the ruling. Uc understand that as of December 76 two tents remnined, (a) response to loss of one main iced pump, and (b) tesrnnna te full load rejection. We assume that these tests will be acecmplished in 1978 successfully pnsses the tests esentioned above in 1978, it is our If the unit opinion that 1978 is the year in which the station is "firnt pinced in service" for income tax purpcscs. However, if these remaining tests should disclose p3jor faultn which would prevent the unit fron necomplirhing its intended purpose, i.e. the generation of electricity for the preduction of income, the "in service" date could very vell be 1979.

A private ruling. LTR 7 833001, dated Ikay 8,1978, supports this pesitien. This 1:ntienni Office Technical Advice Memorandum deals with an netuni enne in which n enibine Influre occurred on December 17, 1973, and uns not fully corrected not11 July 1974.
