Box 1219 Washington, North Carolina 27889 Dear Sant Thank you for your letter of November 7,1979, in which you reaffirmed your position that all HEPA fiiters intended for use in nuclear facilities go to one of the DOE filter testing stations for testing prior to use in these facilitics. As you know, it was ny position and it still is that licensees be given the option of using these test facilities. This posi-tion was upheld by the Regulatory Regulations Revic.r Committee, the ACRS subcouaittee on Regulatory Cuides, the full ACRS committee and the NRC staff. Revision 2 to Regulatory Guide 1.52 issued March 1978 reficcts this position. Nothing has occurred since that time to alter this position.
In establishing this position, we recognize that filter vendors like your-self have the capability to test these filters in accordance with HIL-F-51063 and HIL STD-282. The burden of proof, therefore, rests with you, the vendor, to assure a quality product.
With regard to your co:nents concerning reorganization of NRC, all I can say is that the subject is under discussion, but no time table has been established as to when such a reorganization would take place.
