RESPONSE OF CITY OF GARY ET AL. TO ORDER REQUESTING VIEWS ON PREHEARING CONFERENCE TRANSCRIPTS PetitionersCity of Gary, et al., hereby respond to the questions posed by the Board in its Order of March 28, 1980.

1. Petitioners agree that the transcript of the prehearing conference is deficient. The blatant inaccuracies in tran-scription have uniformly made the arguments presented by all parties almost unintelligible.
2. Petitioners fear, however, that any effort by the parties to attempt to correct their own statements would be a nearly impossible task, given the apparent absence of an audio tape of the proceedings. Aside from the burden of attempting to perform such a task, such wholesale revisions could give rise to disputes among the parties as to whether the rewriting accurately reflects the statements made.

3. Before considering corrections by each party, therefore, petitioners would propose that the stenographers themselves attempt to prepare another transcript from their tapes.

Perhaps without the pressure of preparing the transcript on a daily basis, the stenographers could provide a more accurate

record. At that point, we would suggest that the transcript again be reviewed to determine a procedure whereby the parties may designate additional corrections.
