We would like to bring to your attention a very recent decision of the Commission in Public Service Company of Indiana (Marble Hill Nuclear Generating Station, Units 1 and 2), Memorandum and Order (March 13, 1980). Cole March 27, 1980 Page Two applied in determining whether a petitioner has incurred an injury in fact sufficient for standing to intervene in a proceeding. Given the present status of this proceeding, we do not believe that it would be appropriate to brief the significance of this decision absent express authorization from the Board. However, we do believe that the Board should be aware of this decision before it renders its pre-hearing conference order on intervention.

MEMORANDUM AND ORDER i

The Sassafras Audubon Society (SAS) and the Knob and Valley Audubon Society (KVAS) have requested a hearing on an order issued by the Director of the Office of Inspection and Enforcement. For reasons explained below, the request for hearing is denied.

Background

On August 15, 1979, the Director of the Office of Inspection and Enforcement issued an " Order Confirming Suspension of Construction" to the Public Service Company of Indiana (PSI),

holder of construction permits for the Marble Hill Nuclear i

Generating Station, Units 1 and 2. Pursuant to Section 189a.

of the Atomic Energy Act, the order provided that any person whose interest ma' # -
