ORDER MODIFYING LICENSE l

EFFECTIVE IMMEDIATELY I

The Public Service Electric and Gas Company (the " licensee") is the holder of Operating License No. OPR-70 (the " license") which authorizes operation of the Salem Nuclear Generating Station, Unit 1, at steady state reactor core power levels not in excess of 3338 megawatts thermal (rated power).

The license was I

issued on August 13, 1976.

The facility consists of a pressurized light water moderated and cooled reactor (PWR), located at the licensee's site at Hancocks Bridge, New Jersey.

On May 22, 1979, at approximately 0740 hours0.00856 days <br />0.206 hours <br />0.00122 weeks <br />2.8157e-4 months <br />, while the NRC Resident Inspector was conducting an inspection tour of the Salem Nuclear Generating Statiori, a door, which is part of the interface between Units 1 and 2, was found closed but unlocked and unmanned. This door is required to be locked or manned because it allows direct access into a vital area in Unit 1.

Entry into this vital area also allows unimpeded entry into other vital areas in Unit 1.

Once again ~

on August 28, 1979, the same NRC Resident Inspector, conducting an inspection tour, found the same door unlocked and unmanned.

. t On September 30, 1979, at approximately 1055 hours0.0122 days <br />0.293 hours <br />0.00174 weeks <br />4.014275e-4 months <br />, the NRC Resident Inspector found two paths, described in the attached Notice of Violation which is hereby incorporated by reference, which allowed unimpeded access to two vital areas in Unit 1 from the construction area of Unit 2.

The three occurrences of unmanned open doors and openings describej above and other recent events, described in the attached Salem Nuclear Generating Station Enforcement History which is breby incorporated by reference, demonstrate that the licensee has not adopted appropriate controls to assure that unimpeded entry cannot be c.;ned into vital areas M Unit 1.

The Notice of Violation and the Enforcement History disclose certain aspects of the Salem Nuclear Generating Station Physical Security Plan and are exempt from disclosure under Section 2.790(d) of the NRC's " Rules of Practice, Part 2, Title 10, Code of Federal Regulations.

Accordingly, the Notice of Violation and the Enforcement History will not be placed in the Public Document Room and will be disclosed only in accordance with 10 CFR 9.12.

In view of the importance of physical security and particularly the need to prevent unimpeded and undetected access to vital areas, I have determined that the public health, safety, and interest require an immediately effective modification of License No. DPR-70 as stated in Part III-A of this Order.

Accordingly, pursuant to the Atomic Energy Act of 1954, as amended, and the Commission's regulations ir. 10 CFR Parts 2 and 50, License No. DPR-70 is modified effective immediately, as follows:

(1) Written Security Procedures shall be adooted and implemented (a) to require continuous visual surveillance of all interface doors leading to vital areas in Unit 1, and (b) to prohib.t passage of personnel through the interface barrier except under emergency conditions.

This require-ment will exist as long as the interface serves at the only barrier to the vital areas and also applies to any location throughout the facility r

at which breach of a single barrier will allow unimpeded access to vital areas.

(2) A detailed review of existing security procedures and controls shall be performed to assure that security procedures and controls will not be compromised by maintenance or other activities.

(3) A copy of the written security procedures required by paragraph (1) above and the results of the review required by paragraph (2) above shall be submitted by April 18, 1980, to the Director of NRC's Region I Office.

B In addition, pursuant to the Atomic Energy Act of 1954, as amended, and the Commission's regulations in 10 CFR Parts 2 and 50, IT IS HEREB', ORDERED THAT:

. The licensee shall meet with a senior management official of the Office of Inspection and Enforcement, on April 18, 1980.

The Director, Region I, will inform the licensee at least one week in advance of the specific time and location of the meeting.

IV The licensee, or any other person who has an interest affected by this Order, may, within twenty-five days of the date of this Order, request a hearing.

A request for a hearing shall be addressed to the Director, Office of Inspection and Enforcement, U.S.N.R.C., Washington, D. C. 20555.

A copy of the request for a hearing should also be sent to the Executive Legal Director, U.S. Nuclear Regulatory Commission, Washington, D.C. 20555.

If a hearing is requested by the licensee or a person who has an interest affected by the Order, the Commission will issue an Order designating the time and place of hearing.

Such a request for a hearing SHALL NOT STAY THE IMMEDIATE EFFECTIVENESS OF THIS ORDER.

V In the event the licensee or any other person who has an interest affected by this Order requests a hearing as provided above and a hearing is held, the issues to be considered at such a hearing shall be:

(1) whether the facts set forth in Part II of this Order provide an adequate basis for the actions ordered; and, I

. (2) whether the license should be modified to require the adoption and implementation of written procedures and'the review of existing security procedures and controls as set forth in Part III of this Order.
