Dear Dr. DiSibio:

This is to confirm the discussion Mr. Doda held with you, Dr. Ca/r, and Messrs. Edmundson and Vaden following our review and evaluation of the Nevada radiation control program. The review covered the principal administrative and technical aspects of the program.

This included an examination of the program's funding and personnel resources; licensing, inspection and enforcement activities; emergency response capabilities for agreement materials; and the status of the State's radiation control regulations. There was also a field accompaniment of a State inspector during this review.

As a result of our review of the State's program and the routine exchange of information between the Nuclear Regulatory Commission (NRC) and the State of Nevada, the staff believes that the Nevada program for regulation i

of agreement material is adequate to protect the public health and safety, and is compatible with the NRC's program for regulation of similar materials.

We were pleased to note that the State had included regulations concerning notices, instructions, and reports to workers; and inspections, which are compatible with those contained in 10 CFR Part 19, in the State's revised and updated radiation control regulations that became effective February 28, 1980. Prior to this date, a finding of compatibility with the NRC's program for regulation of similar materials was not possible. This fact was re-flected in each of the three preceding progr 7 reviews where we urged adoption of the Part 19 requirements.

We recommend that improvements be made in the plan for partial inspections at the Beatty radioactive waste burial site with respect to scheduling and documentation.

The addition of a resident site inspector, who the State is planning to add to the staff in the near future, should have a positive impact on the ef fectiveness of this plan.
