We understand that you no logner plan to call Mr. Franklin Rogers as a witness and that Mr. Robert Gross is now listed as a potential witness due to his involvement in settlement negotiations with Texas Utilities.
However, if Tex-La should later decide to make Mr. Gross a witness, we understand that you will advise us of this change and make him available for deposition at that time.
