20036 Gentlemen:
On February 12, 1980, Houston filed a motion to compel further responses by the Department of Justice to Houston's Firs,t Set.of Interrogatories and Requests for Production of Documents.. Counsel for Houston and the Department have conferred and have reached agreement on the matters raised by that motion as follows:
1.
Contemporaneous with filing of witness lists, summaries of testimony and initialed exhibits, the Department will respond i
to interrogatories 1(c)-(d), 8 (a),
9, 110 (c) - (d), 13(a) & (d),
14 (c), 15 (c), 16 (c), 18, 20 (b)-(c), 21 (a) - (c), 23(a)-(b), 24 (a)-
l (b), 2 0 (a) - (d), 32(d) & (f), and 33 (a) by identifying documents, deposition or trial transcript pages and proposed testimony responsive to each~such interrogatory.
The Department shall not be required to identify any documents or portions of 4
-deposition or trial transcripts other than those designated as j
exhibits by the Department cnr relied on in testimony summarized by the Department.
2.
The Department has represented to Houston that its responses to interrogatories 3(b) and 25 (a) and (c) fully state the basis of.the opinions contained in the responses provided by the Department to the extent of the knowledge of the Depart-ment'sl witness Dr. Gordon T.C.
Taylor as of the date the Department's responses were filed.

Houston has agreed to withdraw its February 12, 1980, motion to compel based upon the foregoing undertakings by the Department.
This agreement was communicated to the Board on February 20th in a conference call in which counsel for both the Department and Houston participated.
Houston respectfully requests that, on the basis of this agreement, the Board permit it to withdraw its motion of February 12, 1980.
