Dear Dr. Buck:

This is to confirm the discussion Mr. Ashley held with Dr. Benjamin White and other State representatives following our review and evaluation of the Maryland radiatica control program. The review covered the' principal administrative and technical aspects of the program. This included an examination of the program's funding and personnel resources; licensing, inspection and enforcement activities; field evaluations of State inspec-tors; emergency response capabilities for agreement materials; and the status of the State's radiation control regulations.

As a result of our review of the State's program and the routine exchange of information between the Nuclear Regulatory Commission (NRC) and the State of Maryland, the staff believes that the Maryland program for regulation of agreement material is adequate to protect the public health' and safety, and is compatible with the NRC's program for regulation of similar materials.

We are pleased to note that the radiation control program staff has completed work'on updating and revising the State's radiation control regulations.

The final draf t of the regulations has been submitted to the Department's regulations office for the next procedural step towards adoption.

It has been five years since the regulations were last revised; therefore, we urge that the regulations be promulgated as soon as possible.

Short term courses and workshops should be used to maintain appropriate levels of staff competence. We believe those radiation control program staff members named 'n the State's Energency Plan to respond to emergencies involving agreement materials would benefit greatly from the Radiological Emergency Response Operation course in Nevada. The attendee is given an opportunity to participate as a team nember in responding to a number of real life emergency situations. Thenc situations are wel1 planned and are conducted at the Nevada Test Site.
