Dear Mr. Nelson:
This is to confirm the comments made to you regarding the results of the recent regulatory program review. He believe that the program has continued to improve over the past year.
The reviewers furnished Mr. Corcoran and the radiation control staff with some comments and recommendations; in particular, the need to use caution in extending the scope of some license conditions beyond that specifically defined by the license application. Several instances of this were noted in the license files and, while not improper in themselves, we recommend close review of such instances prior to being included in a license.
The program staff has recently completed the draft of the State's updated and revised radiation control regulations. We look forward to receiving a complete copy of the final draft so that we can provide the State with our comments prior to the adoption of the regulations.
Enclosed.is a copy of our letter to Dr. Buck in which we advise him that the staff believes the Maryland program for control of agreement materials is adequate to protect the pu;;ic health and safety, and is compatible with the NRC's program for reguiation of similar materials.
I appreciate the courtesy and cooperation extended to Mr. Doda and Mr. Ashley by you, Mr. Corcoran and the entire radiation control prcgram staff.
