APPENDIX A NOTICE OF VIOLATION Duke Power Company Docket No.: 50-269 Oconee Site Based on the NRC inspection of December 18, 1979, certain of your activities were apparently not conducted in full compliance with NRC requirements as indicated below. These itens have been categorized as described in correspondence to you dated December 3, 1979.
As required by 10 CFR 71.5, no licensee shall transport any licensed material outside of the confines of his plant or other place of use, unless the licensee complies with the applicable requirements of the regulations appropriate to the mode of transport of the Department of Transportation in 49 CFR Parts 170-189.
Contrary to the above, on December 18, 1979, a radioactive waste shipment (cask) from your Oconee Plant, upon arrival at Chem-Nuclear's waste disposal site at Barnwell, South Carolina was found to be marked with " Empty" labels in addition to " Radioactive LSA" labels. 49 CFR 172.502(a)(2) specifies that no person may affix or display on a motor vehicle any placard unless the placard represents a hazard of the hazardous material being transported.
This is a Severity Level III noncompliance.

RESPONSE
This item resulted from the failure of station HP personnel to remove the "Emp-ty" labels from the cask after it was received at Oconee and prior to shipment to Barnwell.
The Radicactive Shipment Checklist did not specify removal of all labels before affixing new labels for shipment. This checklist is being revis-ed by 2/20/80 to include a sign-off step for removal of all old labels.
HP technicians have been instructed on the removal of thesa labels.

01, Procedure for Shipment and Receipt of Radioactive Material, has been review-ed to ensure no other changes are required.
