Dear Mr. Marshall:
Your January 28,1980 letter to the Nuclear Regulatory Commission requesting a termination of construction at Consumers Power Company's Midland facility has been referred to me for response. You base your current request on sit-ing and spent fuel storage considerations.
As a participant in the operating license proceeding for the Midland facility you are aware that both of these matters are among those over which the NRC Atomic Safety and Licensing Board assigned to hear the case has jursidiction.
Pursuant to the Commission's Rules of Practice, you and your attorney Mr. Grant Merritt, can raise these issues as proposed contentions with the Licensing Board and allinterested parties will be able to respond.
Since your letter did not indicate that it had been provided to the parties in the Midland proceeding, I am providing a copy of it as well as this response to the Licensing Board and the parties.
