As required by the Board's November 30, 1979 order, this letter provides the State of Oregon's views to date on interin operation ~ 6f Troj an.

This letter is also intended to serve as Oregon's response to Intervenor's Decerber 8, 1979

" Motion to Reopen Phase I Evidentiary Hearings, etc."

and the applicant's request, treated by the Board as a no tion, th?t the November 30 order be rescinded.

In its Nover.ber 30, 1979 order, the Board at paragraph 5 requested that " All parties shall state and document their views as to how long interim operation of the Trojan facility should be permitted in the absence of the submission of

fir = plans for control room modifications, adequate frem a safety standpoint to bring the facility into substantial compliance with the license. "

Oregon believes that the Board's December 21, 1978 Initial Decision which permitted interim operation of Trojan, for an indefinite time period subject to certain stringent condi-tions, has an adequate technical basis.

Given that technical de termination, the State of Oregon considers the need for rapid implementation of control building modifications to be based on economic and regional energy concerns and not public health and safety concerns.

Upon closer review, the NRC staff

discovered the test data presented thur far involved walls with +k ee times the amount of reinforcing bar as the relevant Trojan walls, and therefore concluded this test data is invalid.

Thus a decision must be made as to the proper criteria and ass--- tions relating to shear transfer capacity ar i whether T ojan reets the criteria.

There is also significant uncertainty regarding how much m:rtar can confidently be assumed to exist between wythes of blocks, as built, and what effect that assumption has upon shear transfer cabah:.lity.

?GE must make a justifiable assumption regerding the percentage of inter-wythe voids which exist, and demon-that it is acceptable from a safety standpoint.
