COMMENTS ON SECY-76-335 Af ter reviewing the referenced SECY paper,1 believe the proposed letter to Murphy from Chairman Rowden needs a change in direction and tone. As it is now written, the letter does nnthing more than restate Volgenau's terse letter of transmittal to Murphy of June 1, 1976.
As a result it neither,provides Murphy with any useful new information nor does it answer Murphy's specific questions.
I recommend that the letter be reformulated to incorporate an offer to brief Murphy on the scope and purpose of the comprehensive IE study which is referenced in both the Volgenau letter of June 1 and in the Rowden letter proposed in the SECY paper.
Specifically 1 recommend that the second and third paragraphs of the letter be replaced with these or similar words:
I note that in his letter transmitting the ACRS Report to you on June 1,1976 Dr. Ernst Volgenau, Director, Of fice of Inspection and Enforcement, st-ted that the ACRS recommendations will be addressed la the comprehensive study of NRC inspection and enforcement activities currently beginning under his direction. This would include, of
'm course, the ACRS recommendations concerning NRC staffing and the use of outside inspection agencies which were expressly mentioned in your letter.
1 believe the best way to respond to your request would be to have Dr. Volgenau personally meet with you to describe the objectives and scope of his study effort.
I have asked Dr. Volgenau to contact you in the near future to arrange a mutually conven-icnt time for such a discussion.
