ORDER February 13, 1979 Having taken note of the applicant's separate state-ment of position, we hereby approve and accept, in all its particulars, the February 12th stipulation of the parties concerning the intervention of the Natural Resources Defense Council in this spent fuel transfer proceeding.

In light of that stipul.ation, and based upon our own analysis of the record, we are allowing NRDC to intervene in this proceeding on a discretionary 790302cROO

. basis.

To that extent, the January 9, 1979 decision of the Licensing Board denying NRDC's petition to inter-vene is reversed.

A ccpy of the stipulation (together with its "Attachm'ent A") is attached hereto.

It shall be deemed a part of this order.

We consider this order to be of no precedential value insofar as any other proceeding is concerned.
