Gentlemen:
In accordance with my letter to the Board of December 1, enclosed are the Licensee's supplementary proposed findings and conclusions con-cerning equipment qualification, based on the existing record as of November 3 and the additional prefiled testimony.
As indicated in my letter the purpose of such submittal is to facilitate presentation by the parties at the December 11 hearing session of their positions con-cerning this sole remaining subject.
The bulk of the cnclosed supplementary proposed findings and con-clusions (numbered 82a through 82g) are intended to be inserted in the Licensee's propored findings and conclusions of November 20, as the missing Section IV.B, entitled " Evaluations and Analyses Considering l
Response Spectra of Complex."
Those paragraphs could, however, just as readily be inserted at page 27 of the NRC Staff's proposed findings l
and conclusions as the missing Section II.C. (vii), entitled " Floor l
Response Spectra and Seismic Qualification of Equipment."
In that event, the last paragraph of the enclosed submittal (paragraph 32.g.)
could be used at page 36 of the NRC Staff's submittal as the missing paragraph 55.

McCollom Page Two December 6, 1978 We also wish to inform the Board that, having reviewe4rthe NRC Staff's proposed Conclusions of Law and Order (sections VI dnd VII), we withdraw the corresponding portions of our submittal of November 20 (sections VII and VIII) and substitute therefor the NRC Staff's pro-posals, which are more comprehensive.
As the Board will note, our enclosed submittal does not supple-ment or modify the Conclusions of Law and Order.
No such supplement or modificatien is necessary since these portions of the submittal are written broadly enough to encompass an amendment to the operating li-cense authorizing interim operation taking into account both the design deficiency and the related reevaluation of equipment qualification with-in the Complex.
