MINUTES: FOLLOW-UP MANAGEMENT REVIEW BOARD MEETING OF ARKANSAS AUGUST 8, 2019 THE MANAGEMENT REVIEW BOARD MEETING ATTENDEES WERE AS FOLLOWS:

1. Convention. Mr. Robert Johnson convened the meeting at approximately 1:00 p.m.

(ET). He noted that this Management Review Board (MRB) meeting was open to the public. Introductions of the attendees were conducted.

2. Arkansas IMPEP Review. Ms. Michelle Beardsley, Team Lead, led the presentation of the Arkansas follow-up Integrated Materials Performance Evaluation Program (IMPEP) review results to the MRB. She summarized the review and the teams findings for the indicators reviewed. The on-site review was conducted by a team composed of technical staff members from the U.S. Nuclear Regulatory Commission (NRC), the State of Texas during the period of May 21-23, 2019. A draft report was issued to Arkansas for factual comment on June 17, 2019 and responded with minor comment in a letter dated July 15, 2019. Ms. Beardsley reported that the team found Arkansass performance was satisfactory, but needs improvement for the indicator, technical Quality of Licensing Actions. The team also recommended that three of the four recommendations from the 2017 IMPEP be closed and a modified version of the fourth recommendation remain.

3. Previous IMPEP Review and Status of Recommendations a) Recommendation 1: Arkansas should provide additional training regarding the implementation of the Pre-licensing guidance to ensure that staff understand how to properly identify unknown applicants and transfer of control request, when completing the evaluation of the basis for confidence.

The team determined that this recommendation be closed and the MRB agreed.

b) Recommendation 2: Arkansas should revise its procedures to ensure that the qualifications of preceptors are properly verified to attest to the training for new authorized users, authorize medical physicist, and radiation safety officers that are to be added to the licenses.

The team determined that this recommendation be closed and the MRB agreed.

c) Recommendation 3: Arkansas should verify all previously approved authorized users, authorized medical physicists, and radiation safety officers, where the preceptor is not listed on an Arkansas license, where properly qualified to act as a preceptor.

The team determined that this recommendation be closed and the MRB agreed.

d) Recommendation 4: Arkansas should establish a quality control/quality assurance process or similar tool to help improve the thoroughness, completeness, and consistency of the licenses review, as well as to ensure license reviews are of acceptable technical quality with health, safety, and security properly addressed, and that licensing request are properly signed taking any action on a proposed request.

The team determined that this recommendation remain open but be modified and the MRB agreed.

4. Performance Indicators.

a) Ms. Michelle Beardsley and Ms. Vanessa Danese reviewed and presented the common performance indicator, Technical Quality of Licensing Actions. Their presentation corresponded to Section 3.1 of the proposed final IMPEP report.

The MRB, the team, and Arkansas representatives briefly discussed licensing action re Agreement State Program.

The team found Arkansass performance with respect to this indicator to be satisfactory, but needs improvement and the MRB agreed.

5. MRB Consultation/Comments on Issuance of Report. The team recommended, and the MRB agreed, that the Arkansas Agreement State Program be found adequate to protect public health and compatible with the NRC's program. The team recommended and the MRB agreed to close three of the four recommendations and to keep open and modify the fourth one. The team also recommended and the MRB agreed to discontinue monitoring for Arkansas. The team recommended that the next full IMPEP review to take place in approximately 2 years with a periodic meeting in approximately 1 year.
