Fairtile REVIEW STATUS: Complete Cn June 27, 1978, the Maine Yankee Atomic Power Company requested an amendment to the Appendix B Non-Radiological Environmental Technical Specifications (ETS) for Maine Yankee Atomic Power Station. The Itcensee proposed to revise totally the ETS by deleting the biological monitoring programs and by replacing the related limiting conditions for operation (LCO's) by a reference. to the NPDES permit.

The final five-year report on the monitoring programs had been sub-mitted on May 30, 1978 and supports termir.ation of the monitoring programs.

The licensee's justification for replacing the LCO's with the NPDES pemit requirements (by reference) is that water quality limits are outside the NRC's jurisdiction and authority. No technical arguments were offered to support the latter request.

On December 14, 1978, we completed our review of the monitoring programs and recommended that they be teminated. At that time, we did not act on the remainder of the licensee's request which was to delete all the limiting conditions for operation. However, at a meeting in December of 1978 the staff proposed infomally to the licensee that LCO's could be replaced by '

(1) reference to the' NPDES pemit (the LCO's include numerical values which are the same as thuse in the NPDES pemit) and (2) a specific set of reporting requi rements. The licensee responded unfavorably to this proposal and so deletion of the LCO's was delayed, arr-r-k.,

.3 Robert W. Reid FEB 6 220 We have been advised, informally, that the licensee asked OELD to resolve immediately the matter of the remaining LCO's in the Maine Yankee ETS. He were also advised that Mr. Shapar wants the LCO's to be removed as a matter of law. Therefore, we have prepared amended ETS for Maine Yankee which (1) totally rely'on the NPDES permit for the protection of the aquatic environment from non-radiological impacts, and (2) require reports which are designed-to provide the staff with current information on potential environmental problems at the station.

The revised ETS for Maine Yankee, transmitted to you with this memorandum, are consistent with those prepared for all new plants for which OL issuance is pending.

The enclosed ETS should totally replace the existing Appendix B ETS for Maine Yankee.

Mr. Shapar has advised (ref: letter Shapar to Denton dated 12/7/79) that, since this is a ministorial action required as a matter of law, no environ-mental impact assessment need be prepared as a condition precedent to taking the action. Moreover, we have provided a draft copy of the revised ETS informally to Mr. S. Treby of OELD and the enclosed copy incorporates all of his comments. Nevertheless, OELD should be on concurrence for the outgoing acti on.

Because of the licensee's recently indicated. interest in having the LCO's removed expeditiously, we recommend that this action be done by using-a

" twenty-day letter".
