ORDER REGARDING CSW OBJECTION TO REQUEST FOR PRODUCTION OF DOCUMENTS (February 21, 1980)

On February 15, 1980, Central and South West Corporation and its subsidiaries (CSW) filed a motion for a protective order extending the time within which to answer the second set of interrogatories from Houston Lighting and Power Company (HL&P), and relieving it from the duty to produce documents in response to HL&P's second request for production of documents.

A response to this motion was filed by HL&P on February 20, 1980.

The second set of interrogatories and requests were filed by HL&P on February 7, 1980.

Under our Rules of Practice, the interroga-tory responses would be due by February 25, 1980 and the requested documents by March 13, 1980.

The request for extension of interrogatory responses to February 29 is essentially unopposed, and such extension of time is granted.

8003 r3 oo75 CSW seeks to be excused from providing the requested documents because the last date for compliance (March 13) would be beyond the termination date for fact discovery.

This motion is denied.

CSW need not wait until the last date to start producing requested documents.

We have also granted extensions of time to March 14, 1980 for the completion of certain fact discovery at the request of the Staff (Order entered February 14, 1980) and of CSW itself (Order entered February 12, 1980).

CSW is directed to produce the requested documents by March 13, 1980.

It is so ordered.
