CEA MOTION TO PERMIT ORAL ARGUMENT CEA Mereby moves that CEA be permitted to present oral arguments to the Board at the continuing Second Special Pre-Hearing Conference (SSPHC) on Thursday, February 21, 1980, in Bethesda on CEA's Omnibus Motion to the Board (C EA : OMB-8 0. 0 2.13 ) that was served on the Board, NRC(2), and Licensee at the SSPHC in Harrisburg.
Pursuant to the Board Chairman's response to CEA's ex parte request in this matter, CEA has polled.lur telephone the following Intervenors:
TMIA (Theodore Adler), ECNP (Judith Johnsrud),
Steven Sholly, The Aamodts, Newberry Township (Pat Smith), ANGRY (Gail Bradford), Marvin Lewis (Susan Barley), and PANE (Jim Hurst).
CEA has received full and enthnsiastic support from all of the above both for its right to present oral arguments, and for the Omnibus Motion which was described and discussed with the parties. (In those situations where the principal representative of an Intervenor was not contacted, tbe person c :tacted assured CEA that they would be shortly in communication with the principal representative, and would discuss the matter with them, however, in all such cases the persons dontacted expresses with near certainty their opinion that the principal representative would agree with CEA's position).
UCS Counsel Ellyn Weiss has also indicated she has no objections, and she will have William Jordan contact me to discuss the matter, but expets no objectsion from him.

2 Intervenor Sholly sdggested, with which all other intervenors concurred, that adequate opportunity for intervenors to submit written comments would prevail if parties were given a'given number of to do so, days from service of the Omnibus Motion / and indicated his intention to comment in support of it, as did other Intervenors. (Sholly suggested 10 days, however,that would coincide with the February 25 deadline for discovery, posing an additional burden on some, especially the Aamodts and ECNP).
Considering those factors, CEA suggests that written comments be served within twenty days of this date, i.e., by March 6, 1980.
As CEA indicated to the Intervenors polled, a copy of the Omnibus Motion, together with a copy of this motion hss been served on all parties today.
All parties who have not yet been contacted--i.e. PUC, Consumer Advocate, Dauphin County, and the Commonwealth--will be telephoned, and polled to ensure they have no objection. (Parenthetically, NRC in its Reply to Consumer Advocate's Motion -- Intervenor Funding, challenged its standing to argue on the matter).
Furthermore, by this motion, CEA requests that any party having objections to this motion (i.e. to make oral arguments) should notify the Board.at (301)-492-7332.
