SUMMARY

DISPOSITION WITH RECARD TO CFSP CONTENrION 3 STATE OF OREGON

CODrfTY OF COLUMBIA ) SS I, M. H. Malmros, being duly sworn, depose and state:

1.

My name is M. H. Malmros.

I am employed by the Nuclear Regulatcry Commission as a Reactor Inspector in the Reactor Operations and Nuclear Support Branch of the Office of Inspection and Enforcement, Region V.

I have been employed in this position since July 1974. My professional qualifications are contained in an attachment to this affidavit. The affidevit was prepared by me or under my supervision.

I have been assigned as the Trojan Senior Resident Inspector since August 1978. My primary responsibility is the implementation of the reactor inspection program operations phase to verify that the Trojan Nuclear Plant is being operated safely and in conformance with regulatory requirements.

I directly inspect licensee activities and I am assisted by the Trojan Resident Inspector and by personnel from the Region V Office.

The purpose of this affidavit is to address, in part, Contention No. 3 of the Coalition for Safe Power which reads as follows:

Plant Staff review of proposed modifications is inadequate to assure no violations of Technical Specifications will occur.

I have reviewed the statements made in the affidavits of C. Paul Yundt and Richard C. Anderson. These affidavits describe the work plans which are used to provide the instructions and procedures necessary to install an approved modification and the review by the Plant Staff of the work plans to verify that proper controls have been included ec assure that the requirements of the Technical Specifications are mat.

I have examined facility procedures and records and find that an approved procedure for the development and control of work plans is maintained by the Resident Engineer and that approved procedures are maintained by the Plant Quality Assurance Supervisor for the review of work plans to asst.re that technical specification requirements are met during the installation of modifications. The description of work plans and the review process as stated in c'.e affidavits of C. Paul Yundt and Richard C. Anderson is con-sistent with the requirements of these procedures.

Based on my review of the affidavits of C. Psul Yundt and Richard C.

Anderson in support of PGE's motion with regard to CFSP Contention 3 and on my examination of facility procedures and records for the development and reviaw of construction work plans, I concur in the Licensee's statement of material facts set forth in Parts II. A through II.F of the motion with regard to CFSF Contention 3.

I am employed by the United States Nuclear Regulatory Commission as a Reactor Inspector in the Reactor Operations and Nuclear Support Branch, Office of Inspection and Enforcement, Region V, Walnut Creek, California.

I am assigned as the Resident Reactor Inspector for the Trojan Nuclear Plant.

In this position my primary responsibility is the inspection of facility operations for compliance with regulatory requirements and licensee commitments so as to assure the protection of nuclear material and facilities, the environment and the health and safety

.i of the public. This includes direct inspection by myself as well as re-S.

questing and coordinating inspections by specialist inspectors across a broad spectrum of disciplines.

I graduated with a B.S. in Mathematics from Oregon State University in 1963.

t I have also completed the Navy's Nuclear Power Program which included six 4,

t months of schooling in nuclear engineering and six months operational C

training in a land based reactor prototype. Additional training has been d

gained by successful completion of the Office of Inspection and Enforce-f ment courses in basic and advanced pressurized water reactor technology, i

pressurized water reactor simulator training, and inspecting techniques.

Professional experience is as follows:

1963-1970 United States Navy. Served as a commissioned officer in the nuclear submarine program. Qualified as 2~

engineering officer of the watch on three different naval nuclear propulsion systems, SlC, AlW and S5W.

1970-1972 Westinghouse Electric Corporation.

Employed as a project engineer in the operating nuclear plants service group.

I was responsible for facility completion during the startup and operational phases of turnkey projects.

also directly supervised the initial refuelings.

1972-1974 EDS Nuclear Inc. Served as a principal engineer and y'

section manager responsible for the development of quality 1

assurance programs and systens engineering.
