APPENDIX A NOTICE OF VIOLATION Baltimore Gas and Electric Company Docket Nos. 50-317 50-318 Based on the results of an NRC inspection conducted on October 1-5, 1979, it appears that one of your activities sas not conducted in full compliance with the conditions of your NRC Facility License Nos. DPR-53 and DPR-69 as indicated below.
Item A is a Deficiencie.

10 CFR 50.59 states in part, "The holder of a license authorizing operation of a... utilization facility may... make changes in the facility as described in the safety analyses report... without prior Commission approval, unless the proposed change... involves a change in Technical Specifications... or an unreviewed safety question... a written safety evaluation... provides the basis for the determination that the change... does not involve an unreviewed safety question."
The safety evaluation for modification FCR 78-26, Fabrication and Installation of a Sleeving Platfonn, states that an unreviewed safety question is not involved since the Platform was fabricated and installed to Safety Related/ Seismic criteria.
Contrary to the above, the Sleeving Platfonn was not fabricated to Safety Related/ Seismic standards.
