Environmental Technical Specifications
Dear Sir:
Your letter, Reference (b), concluded that LCO's relating to aquatic ecology should be removed as a matter of law. Additionally you proposed to substitute reporting requirements, etc. to allow proper discharge of the NRC NEPA responsibilities, unless Maine Yankee elected to respond within 20 days of your letter (i.e. February 28, 1980).
However, Maine Yankee did not receive Reference (b) until February 19, 1980.
Through telephone conversations with your staff on February 22, 1980, Maine Yankee indicated that we intend to respond. Nevertheless your letter involves an issue which has a broad and significantly potential impact on Maine Yankee, and in view of the late delivery, we would not be able to prepare the desired response within the requested time frame.
It was agreed that Maine Yankee could respond within 20 days of receipt of your letter (i.e. March 10, 1980) without prejudice.
In light of this agreement, we trust you do not intend to initiate steps to issue the substitute Environmental Technical Specifications enclosed with your letter, Reference (b), until you have received our response scheduled for March 10, 1980, or before.
