Dear Mr. Seidle:

This letter is in response to your request that we inform you of the results of our investigation of the allegation regarding the inspection activities of an Authorized Nuclear Inspector (ANI) and the corrective action we have taken concerning this matter.

The ANI has since documented in the Inspector's Diary, Form No. 937 that it was his intention to waive the hold point in question.

The ASME Boiler and Pressure Vessel Code,Section III, Subsection NCA-4134.10, subparagraph C

" Mandatory hold points at which witnessing is required by the states:

Certificate Holder's representative or the Inspector shall be indicated in the controlling documents (NCA-4134.9).

Work shall not proceed beyond mandatory hold points without the consent of the Certificate Holder's repre-sentative or the Inspector, as appropriate." Also the Inspector's Company Handbook allows the Inspector to waive hold points due to extenuating circumstances as long as this action is properly documented.

It is felt that this is an isolated case where the inspector waived a hold point and did not follow the proper procedure.

This proper procedure for waiving hold points has been reviewed with the Inspectors as documented in a letter dated November 12, 1979, to the Inspectors from the Regional Manager for the Inspection Agency.
