Dear Sir:
In reference to the NRC letter of January 2, 1980, the Authority feels that misunderstandings persist regarding the need for approval of the new spent fuel rack installation and the basis for a low priority given to this topic by NRC.
The Authority's initial submittal requesting approval to install increased capacity spent fuel racks was in July, 1978.
A technical review was subsequently made by the NRC staff, and additional information requested.
All additional infornation requested by the staff was furnished by the Authority, and there have been no outstanding matters as of October, 1979.
We also note that fuel racks essentially identical to those that are proposed for JAF have been approved for the Duane Arnold Nuclear Plant.
Therefore, we assume that your approval to in-stall the racks could be given with only a small additional effcrt.
Iu your January 2, 1980 letter you indicated that the issue of the FitzPatrick spent fuel racks have been assigned a low priority due to the heavy post-TMI work load within the NRC.
We can understand that the workload within the NRC may be extremely heavy at this time and that prioritization of your efforts is required.
However, it is our understanding that in this post-TMI period at least four applications for spent fuel storage expansion have received approval *.

Nuclear Regulatory Commission The Authority's concerns about receiving your approval to install the fuel racks in time to have capability for full core offload during the coming refueling outage, are significant.
We believe that it is sound business management practice to anti-cipate problems of safety, radiation exposure, or cost impact.
In the event that reactor vessel related repairs should be neces-sary, they may require, or at least be facilitated by, removal of the reactor core.
Removal of the reactor core would signifi-cantly reduce radiation exposure associated with such work.
If reactor vessel repair should be required, and full core offload capability is not in place, the JAF spring outage could be extended by one month since such work would have to be in series with planned torus work.
If core removal is required for the repair, the outage would be extended by the time required for NRC approval for the subject spent fuel racks plus the time for their instal-lation.
We, therefore, urgently reiterate our request for approval to install new increased capacity spent fuel racks at JAF.
The Authority could, if approval is received by March 15, 1980, install a sufficient number of racks to allow full offload of the reactor core during this upcoming outage.
