("HL&P") answers HL&P's first set of interrogatories as follows:

Since January 1, 1968, WTU has discussed with the following utilities the possibility that these utilities might sell electric power to WTU:
Public Service Company of Oklahoma, Central Power and Light Comp,y, City of San Antonio, Southwestern Public Service Company, El Paso Electric Company, Southwestern Electric Power Company, Lower Colorado River Authority, Texas Electric Service Company, Texas Power and Light Company, Western Farmers Electric Cooperative, City of Brady.

Answe r to Interrogatory No. 7:
The answer to this Interrogatory as it portains to purchases by WTU can be obtained from the documents attached hereto and designated as pages 7-1 through 7-19.
Answer to Interrogatory No. 8:
The answer to this Interrogatory as it pertains to sales by WTU to of f-system customers can be obtained from the documents attached hereto and numbered page 8-1 through 8-15.
The answer to this Interrogatory as it pertains to sales by WTU to on-system customers can be obtained from the FPC Form-l's previously made available for inspec-tion and copying.
Answe r to Interrogatory No. 9:
Since January 1, 1968; WTU has not refused to sell electricity to any utility that has requested to purchase electric power from WTU.
. Answer to Interrogatory No. 10:
Since January 1, 1968, WTU has from time to time offered to sell economy power to the Lower Colorado River Authority, but all these of fers have been refused.
During this pe riod, WTU of fered to sell electricity to Baird, Brady, Coleman, Winters, and Vernon, but these were refused.
Sub-sequently, all these cities purchased power from WTU except the City of Vernon.
In 1979, WTU, at the request of the City of Seymour, discussed with the City the price it could sell electricity to the City (at that time a customer of Brazos Electric Power Coop ).
The City is still receiving its electricity from Brazos.
Documents relating to these offers have been made availabic for inspection and copying in Abilene, Texas.
I n Nove mbe r, 1977 WTU approached TESCO to explore the possibility of selling economy energy to TESCO.
Docu-ments relating to this matter are attached hereto and numbered as 10-1 and 10-2.
Answer to Interrogatory No. 11:
All of the transactions with the municipal system identified in Answer to Interrogatory No. 10 would have in-volved an interconnection.
In 1976, WTU requested partici-pation in the Comanche Peak nuclear p'. ant being constructed by TU, ou. TU has not responded affirmatively to that request.
Interrogatory No. 12:
Arfw r WEU had been of fered the right to participate in the ownership of the t!ortheastern 3 and 4 generating units being
. constructed by Public Service Company of Oklahoma.
WTU has been compelled to decline to participate in the ownership of these units because of the orders of the Texas Public Utility Commission in Docket 14 and the intrastate-only restrictions imposed by HLP and the TU companies.
Answe r to Interrogatory No. 13:
None.
Answer to Interrogatory No. 14:
Since January 1, 1968, the Public Utilities Board of the City of Brownsville, Texas, the El Paso Electric Com-pany and various cooperatives and REA's have requested partici-pation in coal or nuclear powered electric generating plants being built or planned by WTU and its affiliated companies.
Answer to Interrogatory No. 15:
Since January 1, 1968, WTU has received 1.' such request.
Answe r to Interrogatory No. 16:
Between Janua ry 1, 1968 and the ef fective certi-fication of service areas in 1976, WTU did not refuse to sell electricity to any industrial concern.
Since that time, WTU has not refused to sell electricity to any industrial concern located within its certificated service area.
Answer to Interrogatory No. 17:
In 1976, WTU advised a prospective industrial cus-tomer that WTU did not have sufficient existing capacity to serve a 300 to 475 megawatt load that waa proposed.
The pro-spective customer was advised that WTU would require seven
. years to build a generating plant to serve that load.
Docu-ments relating to the matter set forth in this answer have been made available to counsel for HL&P for inspection and copying.
Answe r to Interrogatory No. 18:
WTU does not know whether any existing or potential industrial customer has located a new facility in HL&P's ser-vice area instead of the service area of WTU, or has expanded an existing facility in HL&P's service area instead of in WTU's service area since Janua ry 1, 1968, solely because of the dif ference in the reliability of the electric service between HL&P and WTU.
Answer to Interrogatory No. 19:
WTU offered to serve Aileen, Inc., Bandag, Inc.,
Western Iron Works, Gulf Oil Corporation, Ozona Gas Process-ing Plant and Duval Corporation at rates dif ferent from the rate in existence or on file at the time of the offer.
The of fers to Aileen and Bandag were made in the early 1970's, and both Aileen and Bandag located in WTU's service area.
WTU i
had not sold either of these customers electricity before either located in the WTU service area.
The offer to Western Iron Works made in the early 1970's included a new of f-peak rate for service to a proposed electric furnace which Western later installed to replace its gas-fired furnace.
The offer to Gulf Oil, made in the early 1960's, reduced an existing rate to provide service to the McElroy water-flood project.
. The offer to Ozona made in the late 1960's included a new discount rider applicable u icer certain conditions to gas processing plants.
The offer to Duval made in the late 1960's expanded the application of the discount rider created for Ozona to include sulphur high-continuous annual operation plants.
Documents relating to the matters set forth in this answer were made available to counsel for HL&P for inspec-tion and copying in connection with the Dallas antitrust case.
Answer to Interrogatory No. 20:
Since January 1, 1968, WTU has served the following industrial customers under a rate under which these customers have been the only customers served:
Aileen, Inc., Bandag, Inc., Western Iron Works, Gulf Oil Corporation, Ozona Gas Processing Plant, Duval Corporation, and Intratex Gas Company.

Service was extended to Intratex Gas Company on July 15, 1972, under the terms of a contract dated January 18, 1972.
The contract provided for an initial 5 year term at the then applicable LWP-6 rate.
Se rvice to Duval Corporation was commenced on December 1, 1967, under the terms of a contract which provided fr r an initial term of 5 years with a 5 year extension unless 180 days written notice was given by either party to the other prior to the expiration of the initial 5 year term.
The con-tract included the Company's rate schedulo LPL-3 which was in ef fect at that time.

. On Janua ry 1, 1973, the Company's 6% general rate increase went into effect for all customers except those whose contracts with the Company would not allow the rate change.
This revised rate was made ef fective for Intratex Gas Company at the expiration of the 5 year contract.
The 180 da; notice required by the contract with Duval Corporation was not met and that contract was automatically extended for an additional 5 years in accordance with the contractual pro-visions.
At the time service was commenced to Duval Corpora-tion and Intratex Gas Company, the rates applicable to them were the Company's standard rates for such service.
- However, due to the provisions of the respective contracts, these customers becare the only customers served on those rates a f ter the January 1, 1973, rate increase was made ef fective.
Answe r to Interrogatory No. 23:
WTU does not know whether any existing or potential industrial customer has located a new facility in HL&P's ser-vice area instead of WTU's service area, or has expanded any existing facility in HL&P's service area instead of build-ing a new facility or expanding an existing facility in WTU 's service area, since January 1, 1968, solely because of the dif fe rence in the cost of electricity between HL&P and WTU.
Answe r to Interrogatory No. 24:
Recent computer installations by several pipeline
. companies have resulted in the selection of pumping stations that have lower electric rates and higher efficiencies.
WTU does not know whether this reduction in energy purchased f rom WTU was made up by increased purchases from HL&P.
Answer to Interrogatory No. 27:
Since January 1, 1973, WTU has engaged in energy conservation advertising in various media, and has made contacts with industrial customers to advise those customers that a WTU representative would be available to come to the customer's location and recommend ways in which the customer could conserve consumption of electric power.
Answer to Interrogatory No. 28:
The total amounts which WTU has spent for advertising, to encourage customers to locate or expand within WTU 's ser-vice area, and to encourage customers to conserve electricity a re as follows:

In February, 1979, representatives of WTU discussed with representatives of Stone & Webster the possibility of interconnecting WTU with El Paso Electric Company through a DC tie.
Documents relating to this subject matter have been made available for inspection and copying in Abilene, Texas.
Also, from time to time, a DC interconnection between WTU and the Southwest Power Pool has been considered by consul-tants retained on behalf of the Central and Southwest Companies.

Novembar 11, 1977 Harrold Bassinger with TESCo called and said he was informed by his people that we had some entegy for bid.
I said we had some economy energy.
He asked the price, and I told him I hadn't worked up any price for the energy.
I said I would need tt know his cost for energy to work this up, because we were offering energy on split saving basis.

4 November 29, 1977 Harrold Bassinger with TESCo called and asked if I had decided on a price for energy.
I said I had not because I didn't know their decremental cost.
I said we are offering this energy on economy basis split saving. He said he didn't know what their decremental cost was but based on split saving, it would be too high. He asked our cost, and I explained fuel plus adder was estimated to be 18.80. mills /KWH for the month of December, but we bill on actual fuel cost, plus 10% for split saving. He said he would discuss this with his people.
