Motion for Establishment of Schedule for Prehearing Conference.

Mt On January 10, 1980, Northern Indiana Public Service Commission ("NIPSCO") moved for the establishment of a schedule for a prehearing conferenc2 and the submission of related filings, including the identification of specific contentions which petitioners wish to address. In their petition to inter-vene, the City of Gary, Indiana, United Steelworkers of America Local 6787, the Bailly Alliance, Save the Dunes Council and the Critical Mass Energy Project identified the contention which they intend to raise in this proceeding, namely the absence of emergency response capability in the area surrounding the Bailly site. Petitioners thus need not address the appropriateness of NIPSCO's suggestion that , specific contentions must be identified prior to discovery.

Petitioners do, however, intend to supplement their petition in response to the filings by NIPSCO and the NRC.

staff. If the Board determines to set a schedule for the submission of such filings and to establish a date for a prehearing conference, petitioners suggest that supplements to petitioners be filed fourteen days after entry of an order by the Board, and responses thereto be filed ten days there-
