Dear Mr. Costle:
. In view of the need to avoid delay in initiating the activities of the Federal Radiation Policy Council, I agree with your intention that we should under-take necessary preliminary steps.
As you requested in your letter of November 30, 1979 I hereby designate Mr. Robert B. Minogue to be the NRC representative on t.he Council.
Mr. Minogue's position as Director, Office of Standards Development is equivalent, in our view, to that of an Assistant Secretary in a cabinet level department as required by the recent draft of the Executive Order that would form the Council.
As you indicated in your letter, changes in the final Executive Order might necessitate a different level of Agency representation.
I also noted that recently introduced legislation might also require such a change.
Bob Minogue represented the Nuclear Regulatory Commission on the Federal Task Force on the Health Effects of Ionizing Radiation (Libassi-Cotton Task Force) and in several Congressional hearings on this topic held by the Senate Governmental Affairs Committee and the House Committee on Government Operations.
In his role as Director, Office of Standards Development, Bob Minogue is directly involved with developing radiation protection standards for all areas within NRC's responsibilities.
There-fore, we believe that he is well qualified to be our representative on the Council.
We fully support the work that the Council will undertake to provide better coordination and oversight of Federal radiation protection activities.
Increased coordination and improved effectiveness of Federal radiation programs will provide more uniform and more complete protection of public health and safety from ionizing radiation.
