Dear Mr. Chairman and Members of the Board:

This is to inform you that barring unexpected develop-ments, we will not be present at the February 13 prehearing conference on behalf of People Against Nuclear Energy (PANE). Instead, PANE will be represented by its President, James Hurst, or one of its members.

We have decided not to appear ourselves because the prehearing conference will apparently deal primarily w.ith discovery and scheduling matters, all of which remain in limbo for our client until a decision is reached on the psy-chological distress contentions. Since, as we recently in-formed the Board, PANE is unable to afford further represen-tation until the NRC provides funding, we cannot justify the expense to PANE of our appearance on their behalf unless absolutely necessary.

Thank you for your consideration. We regret that we will be unable to be present, but we expect that PANE's representatives will be able to provide the Board with any information or assistance that it may need.
