through its attorneys and pursuant to Section 2.740 (c) (1) of the Rules of Practice of this Commission, moves for a protec-tive order with respect to the First Set of Interrogatories and Requests for Production of Documents served on it by Texas Utilities Generating Company ("TUGCO"). Specifically, Movant requests that it be relieved from complying with the TUGCO discovery request in any respect, alleging as grounds therefor that it is not party to or intervenor in either the South Texas Project or Comanche Peak dockets and therefore is not subject to discovery through interrogatories or requests for production of documents. Sections 2.740(b) and 2.741 of the Rules of Practice specifically provide that interrogatories and requests for documents may be served by 8002200 3 6> 4

a party only upon "any other party."

WHEREFORE , Movant respectfully requests that this Board enter a Protective Order relieving it from responding in any respect to TUGCO's First Set of Interrogatories and Requests for Production of Documents.
