MOTION FOR EXTENSION OF FACTUAL DISCOVERY PERIOD The NRC Staff hereby moves the Licensing Board for an extension of the factual discovery period for an additional two weeks, until March 14, 1980. Pursuant to the Board's Order of December 14, 1979, the present factual discovery period terminates on February 29, 1980. As is evident from the various discovery status reports, all parties, including the Staff, have been engaged in intensive depo-sition and discovery programs over the past six months.

Certain depositions during this period of time have had to be delayed or post-poned for various reasons.

In keeping with the Board's directive to resolve discovery disputes informally if at all possible, the rescheduling of certain Gulf States Utilities has been attempted but has not come to fruition. The application of Houston Lighting & Power Company, on February 5,1980, for seven additional subpoenas and depositions during the last two weeks of February makes it virtually impossible to reschedule the Gulf States depositions by February 29, 1980. The Staff anticipates the Gulf States depositions will be very important to the factual determinations in these proceedings.

2 Accordingly, the Staff requests a two week extension of the factual discovery period until March 14, 1980 in order to schedule the Gulf States depositions a nd any follow-up discovery found to be necessary as a result of those depositions.

The Staff has been authorized to state that the following parties do not oppose this motion for an extension:

United States Department of Justice, the Tex-La Cooperatives, Public Utility Board of Brownsville, and Central and Southwest Corporation, and its subsidiaries.
