LICENSE AMENDMENT APPLICATION DATED NOVEMBER 7,1979

Background

Duke is licensed under NRC Materials License No. SNM-1773 for the storage of fuel and accessories for eventual use in the McGuire Nuclear Station, Unit 1.

The license is scheduled to expire December 31, 1979.

By application dated November 7,1979, Duke has requested an extension of the expiration date to December 31, 1981.

Discussion By application dated November 20, 1978, Duke had asked for a license extension from December 31, 1978, to December 31, 1979, and that license expiration date no longer be tied to issuance of the facility operating license. The license amendment granting that extension was issued December 17, 1978.

In the SER dated December 17, 1978, the following information~was documented:

"Mr. R. Birkel, Reactor Licensing Project Manager, advised me on December 11, 1978, that because of various delays it is necessary to extend the date for completion of Unit 1 under Construction Permit No. CPRR-83. He also stated that he saw no objection to either extending the expiration date to December 31, 1979, or to no longer tying the expiration date to conversion of the CP to an OL.

Mr. J. Saitzman, Chief, Antitrust and Indemnity Group also advised on December 11, 1978, that he had no objections to Duke's proposal subject to ELD concurrence.

Mr. R. Hoefling, ELD, told me on December 11, 1978, that ELD agreed with the Duke proposal and that he had no problem with our issuance of the license extension as requested by. Duke."

DEC 101979 In addition, on December 3,1979, I confirmed with Mr. R. Birkel that he had no objections to our issuance of the license extension requested by Duke.

Further, an extension of the license expiration date does not affect the radiological safety, nuclear safety,,or other parameters on which was based the issuance of the license.

Recommendation I recomend that the license extension be granted as requested by Duke.
