December 6, 1979 0FFICE OF INSPECTION AND ENFORCEMENT EN-79-14 NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Consumers Power Company Midland, Unit Hos. 1 and 2 Docket Hos. 50-329 and 330 Midland, Michigan

ORDER MODIFYING CONSTRUCTION PERMITS This is to inform the Commission that an Order m,odifying NRC Construction Permit Nos. CPPR-81 and 82 is being issued to Consumers Power Company on December 6,1979. This action is based on quality assurance deficiencies involving settlement of the Diesel Generator Building and soil construction activities at the Midland site, a material false statement in the FSAR, and an unresolved safety issue concerning adequacy of the licensee's actions to correct deficiencies in soil construction under and around safety-related structures and systems.
These matters do not involve an immediate threat to the health and safety of the public.
A news release has been prepared and will be issued about the time the licensee receives the Order.
The IE Director discussed this Order with the licensee on December 6,1979. The State of Michigan will be notified by Region III (Chicago).
The schedule for issuance and notification is:
