MEMORANDUM By letter dated September 13, 1978, E. A. Adomat, Executive Vice President of Florida Power and Light Company advised the Director of Nuclear Reactor Regula-tion that the application in Docket No. P-636-A should be deleted from the Commission's docket of pending applications.
The Commission's Rules, 10 CFR 92.107 (a ) provides in pertinent part that, " Withdrawal of an application after issuance of a notice of hearing shall be on such terms as the presiding officer shall prescribe."
A notice of hearing having issued in this proceeding, the Board considered the withdrawal of the application at a conference convened on September 19, 1978.
Every party attended and none objected to the withdrawal of the application.
The Board could determine no reason why the 76110-iOMT Florida Power & Light Company should not be permitted a
to withdraw the application.
Accordingly on September 19, 1978 the Board approved the withdrawal of the application without terms.
