Dear Mr. Chairman:
This is in response to your August 21, 1980 letter expressing concern about issuance of an operating license for the North Anna Unit 2 nuclear power plant without formal approval by the Comission itself.
Issuance of the North Anna Unit 2 license was strictly in accord with the Commission's October 1979 and June 1980 policy statements.
In accordance with those policy statements, the license was issued only after formal vote of the Comission.
We believe that the newspaper story you saw did not use the NRC press release nor follow the Comission meeting.
The press release, copy enclosed, made clear that the license was authorized by the Comissioners.
In addition, each license issued by the Comission has been accompanied by a transmittal memorandum to the appropriate licensing docket file.
This memorandum is placed in the NRC Public Document Room and is served on all parties of record to the proceeding.
A copy of the transmittal memorandum in the North Anna Unit 2 operating license issuance determination is enclosed.
Commissioner Gilinsky feels that the transmittal memorandum cited above should be clearly identified as an " Order" and should incorporate your suggestion that each licensing action under the policy statements explain the basis for the Commission's involvement.
Whether additional expression of Commission views is desirable will be considered on a case-by-case basis.
