Dear Congressman Zablocki:
Your August 15, 1980 letter to Chaiman Ahearne regarding a constituent's letter concerning the Point Beach Unit 1 facility has been referred to me for response. As noted in the letter you enclosed from Professor Neess, the Cmrnission has referred a request by Wisconsin's Enviromental Decade for an adjudicatory hearing to an Atomic Safety and Licensing Board for a detemination of whether a hearing is required. As part of its adjudicatory functions, the Comission may be called upon to participate in the review of decisions and rulings of the Licensing Board in connection with the ongoing proceeding. Since Professor Neess' letter deals with matters relevant to the earlier request for a hearing by Wisconsin's Environmental Decade, it would be inappropriate for the Chaiman to coment on his letter at this time.
A copy of your letter with the enclosure from Professor Neess and this response will be sent to the Board and all participants in the proceeding.
