Dear Senator Proxmire:

Your August 15, 1980 note to our Office of Congressional Affairs regarding a constituent's concerns on the Point Beach Unit I facility has been referred to me for response. As noted in the letter you enclosed from Professor Neess, the Commission has referred a request by Wisconsin's Environmental Decade for an adjudicatory hearing to an Atomic Safety and Licensing Board for a detennination of whether a hearing is required. As part of its adjudicatory functions, the Commission may be called upon to participate in the review of decisions and rulings of the Licensing Board in connection with the ongoing proceeding.

Since Professn-Neess' letter deals with matters relevant to the earlier request for a nearing by Wisconsin's Environmental Decade, it would be inappropriate for us to comment on his letter at this time.

A copy of your letter with the enclosure ~from Professor Neess and this response will be sent to the Board and all participants in the proceeding.
