DD-80-4 UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION In the Matter of PUBLIC SERVICE ELECTRIC & GAS Docket No. 50-272 I
COMPANY (Salem Nuclear Generating
)
Station, thit 1)
)
DIRECTOR'S DECISION UNDER 10 CFR 2.206 By petition dated October 18, 1979, Mr. and Mrs. Alfred Coleman requested the Nuclear Regulatory Comission to issue a show cause order to Public Service Electric and Gas Company to suspend or revoke the operating license for Salem Unit 1 because of alleged violations of the Endangered Species Act of 1973. The Colemans' petition has been treated as a request for action under 10 CFR 2.206 of the Commission's regulations. Notice of receipt of the petition was published in the Federal Register, 44 FR 67253 (November 23, 1979).
After consideration of the infonnation submitted in the Colemans' request and consultation with the National Marine Fisheries Service, I have determined that the continued operation of Salem Unit 1 will not result in any violations of the Endangered Species Act. Consequently, this request to suspend or revoke the license is denied.
A copy of this decision will be placed in the Commission's Public Document Room at 1717 H Street, N. W., Washington, D. C. 20555 and at the local public document room for the Salem Nuclear Generating Station, Unit 1, located at Salem Free Public Library,112 West Broadway, Salem, New Jersey 08079.
