Dear Senator Glenn:

The letter from your constituent, Mr. Paul E. Tobergte, which you forwarded to the Nuclear Regulatory Conmission (NRC) for consideration, has been referred to me for response.

In Mr. Tobergte's letter he expressed concern regarding the cancellation of plans to build a nuclear power plant at the abandoned naval landing field in Charlestown, Rhoce Island.

The nuclear facility referred to in Mr. Tobergte's letter was the proposed NEP-1 and NEP-2 plants to have been constructed by the New England Power Company.

The proposed site for the plants, the abandoned naval landing field, is located in Washington County, near Charlestown, Rhode Island, approximately 8 1/2 miles east of the center of Westerly, Rhode Island. Providence, Rhode Island is approximately 35 miles north of the site.

The New England Power Company tendered its application for NEP-1 and NEP-2 on August 2, 1976, and the NRC staff's detailed review was begun on January 31, 1977.

The delay between tendering of the application and the star t of the review was at the request of the applicant to allow the New England Power Company more time to clarify its negotiations for the abandoned naval landing field which is owned by the General Services Administration (GSA).

Although the NRC is not involved in acquisition of a site, we do require that an applicant have the authority to determine all activities in an area surrounding the reactors which we call the " exclusion area." This regulation and other NRC regulations governing reactor site criteria are given in the Code of Federal Regulations, Title 10, Part 100.

The NRC staff review of the NEP-1 and NEP-2 application was nearing completion when on June 20, 1979, the GSA decided that the site should be transferred to the Department of Interior, the Environmental Protection Agency, and the Town of Charlestown for wildlife refuge, environmental research, and municipal and recreational purposes.

The Honorable John Glenn On December 17, 1979, the applicant filed a motion with the Atomic Safety and Licensing Board (Board) to withdraw their application. On December 26, 1979, the Board issued an order granting the applicant's motion to withdraw its application.
