s' wAmun-1 January 21, 1980 MEMORANDUM FOR:

Comissioner Gilinsky Commissioner Kennedy Commissioner Hendrie

. p ?.'-,

Commissioner Bradford I. h e FROM:

John Ahearne SbBJECT:

RESUMPTION OFsCONSTRUCTION AT MANSLE HILL Construction at Marble Hill is still suspended because of the quality assurance concerns.

I believe the Commission should be involved with the decision to allow construction to resume since that decision may involve important policy considerations.

' Consequently, I suggest we instruct the Staff to brief us when they believe the situation is sufficiently improved to allow construction to resume so we may discuss that decision with them.

I am asking SECY to poll the Co=nissioners on this cuestion.

Dear-Mr. Chairman,

ME

==

- U^5 Thank you for the recent response to my letter supporting

-iE Congressman Moffett's suggestion that the Commissioners make KdE the final decision on restarting construction at the Marble ggi; Hill nuclear power plant in my congressional district, which p@:

was sent to me by Mr. Bickwit. I appreciate hearing from the M

Commission.

+kY

5 I would like some further clarification on the response I recieved. In his letter, Mr. Bickwit states that the FE

Commission has "already taken action to participate -

a decision to restart construction at Marble Hill." He als

.E.

~=

s states that "the Commission requested that-it be briefed J

by the staff prior to a lifting of the suspension order."

isiss th.8 To what extent has the Commission participated in the Im=

decisi~on-making process? If the Commission has requested E

that it be briefed on any staff decision, does that mean Isti_~

the Conmissioners plan to simply concur with a staff de-cision, or will they examine any staff decision before Eff!

allowing construction to restart.

I would also appreciate a further exulanation as to e.

the relationship between this request and'the pending hearing'

=

request before the Commission.

q=;

' Thank you for your continued.-consideration in this

?l;?

mat'ter. I look forward to heari(g # rom you in the near E

. future.
